item reflects the extension of the Power for Jobs program to June 30, 2007.

5. Request to Approve Extensions to
the Term of Service for 14
Existing Economic Development Power Program Customers
Summary
The members of the Economic Development Power Allocation Board (Power Allocation Board) are requested to recommend approval of an extension to the term of service to June 30, 2007 for 14 existing economic development power program customers, as listed in Exhibit “5-A.”
BACKGROUND
The New York Power Authority sells electricity to businesses under several state-authorized economic development programs. These power sales are made through the Economic Development Power program, High Load Factor Manufacturer program, Municipal Distribution Agency Industrial Power program and other power sales programs. The capacity and energy for these sales are provided by market purchases and supported by other Authority sources as needed. In some instances, these customers are served directly by the Authority and in other cases, the customers receive Authority power through resale arrangements with municipal distribution agencies or investor-owned utilities. Contracts range in length from 5 to more than 20 years.
DISCUSSION
Chapter 313 of the Laws of 2005 was signed into law by Governor George E. Pataki on July 26, 2005. The new law allowed certain Authority power program customers that would be exposed to bill increases as a result of higher market prices before December 31, 2006 to apply for an Energy Cost Savings Benefit. Under this law, businesses eligible to receive Energy Cost Savings Benefits are limited to Authority customers currently supplied power under the Economic Development Power, Municipal Distribution Agency and High Load Factor programs. The Energy Cost Savings Benefit was available for the period November 1, 2005 through December 31, 2006. In 2006, a new law (Chapter 645 of the Laws of 2006) included provisions extending these benefits until June 30, 2007.
The
customers detailed in Exhibit “5-A” have allocation contracts, previously
recommended by the Power Allocation Board and approved by the Power Authority
Trustees that expire on December 31, 2006.
We are requesting the Power Allocation Board to recommend that the
Trustees extend these agreements until June 30, 2007 so that the customers may
receive the benefits associated with the recently passed law. The extension will help maintain costs and
enable the customers to compete more effectively. In addition, it will further secure
employment levels in
RECOMMENDATION
It is requested that the Power Allocation Board recommend extensions to the term of service to June 30, 2007 for the fourteen existing economic development power program customers, as listed in Exhibit “5-A.”
Following consideration of such applications, the Members of the Board present voted unanimously to extend the contracts.

of Section 184 of the Economic Development Law; and be it further
RESOLVED, That the Board hereby recommends to the Power Authority of
the State of New York the total allocation of 27,773 kW to extend the existing
contract of the business listed on Exhibit “5-A” to June 30, 2007, and that the
terms set forth on such Exhibit “5-A” be incorporated into the Authority’s
contract for Economic Development Power.

6. Economic
Development Programs - Energy Cost Savings Benefits
SUMMARY
The Members of the Economic Development Power Allocation Board (Power Allocation Board) are requested to recommend approval of Energy Cost Savings Benefits for 32 companies as listed in Exhibit “6-A.”
BACKGROUND
Chapter 313 of the Laws of 2005 was signed into law by Governor George E. Pataki on July 26, 2005. The new law allowed certain Authority power program customers that would be exposed to bill increases as a result of higher market prices before December 31, 2006 to apply for an Energy Cost Savings Benefit. DISCUSSION
The 32 organizations listed in
Exhibit “6-A” have agreed to retain more than 14,000 jobs in
FISCAL INFORMATION
Funding of Energy Cost Savings Benefits for the all the companies participating in the program is not expected to exceed $5,000,000.
RECOMMENDATION
The Power Allocation Board is requested to recommend that the Authority’s Trustees approve Energy Cost Savings Benefits to the 32 businesses listed in Exhibit “6-A.”
Mr. Pasquale presented the highlights of
staff’s recommendations to the Board. In
response to a question from Mr. McGarry, Chairman McCullough said that the
Authority has been reviewing the other provisions of the recently passed
legislation since it was signed. He said
that the Authority has serious concerns about how such provisions may affect
its bondholders and bond ratings, as well as the financial impact in relation
to the Authority’s budget going forward.
After staff has completed its analysis, a presentation will be made to
the Authority’s Trustees, hopefully by the November Trustees’ Meeting. Mr. Kelly added that there are constitutional
issues to be addressed with regard to these provisions of the legislation, as
well as the Authority’s covenants with its bondholders. Chairman McCullough promised to keep the
other EDPAB members in the loop as the process moves forward.
Following consideration of such applications, the Members of the Board present voted unanimously to adopt the following resolution:
NOW THEREFORE BE IT RESOLVED, That the
Board hereby finds and determines that such applications meet the requirements
of the energy cost savings benefits under the Power for Jobs legislation
contained in Article 6 of the Economic Development Law as amended by Chapter
645 of the Laws of 2006; and be it further
RESOLVED, That the
Board recommends to the Power Authority of the State of New York the 32
applications for energy cost savings benefits discussed herein totaling 59,373
kW until June 30, 2007.

7. Transfers
of Industrial Power
The proposed transferees are as follows:
Beaverite Corporation, a leading manufacturer of die cut solutions
for various industrial and commercial applications and is located in
Snyder Industries, Inc., a contracted supplier of machined
components for the mining and other heavy equipment industries, is located in
Stella D’oro Biscuit Co., Inc. is a commercial bake goods company
operated as a division of Kraft Foods in the Bronx,
Stellex Monitor Aerospace Corp. (‘Stellex’), located in
It is recommended that the Power Allocation Board approve the name and or location changes detailed above.
Following consideration of such recommendations, the Members of the Board present voted unanimously to adopt the following resolution:
RESOLVED, That the
members of the Economic Development Power Allocation Board hereby approve name
changes to the four companies as described in the above memorandum to the
Board.
8. Next Meeting
Chairman
McCullough said that the date for November’s EDPAB meeting would be selected
soon and that the EDPAB members would be informed as soon as possible. In response to a question from Mr. Corbett,
Chairman McCullough said that the Authority does not anticipate any changes in
the immediate future as a result of the upcoming change in administration.
